Access Can Be Granted to Private Facebook Pages
Ms. Eniko Rakosi, was injured in a May 5, 2008 motor vehicle accident. As a result, she applied for statutory accident benefits available under the Schedule from her first-party insurer.
During the period she was applying for and receiving benefits she posted pictures of herself ziplining to her private Facebook page.
This appeal decision revolved around whether Ms. Rakosi had an expectation of privacy given the number of people who had access to the images, the relevance of the information to the case.
The case is a lengthy one, but the appeal ruling is important.
