Insured back to pre accident activity level and therefore no Non Earner Benefit payable.

Entitlement to non-earner benefits requires a claimant to compare their 'normal life' before the automobile accident with their normal life afterwards. In this case the insured continued to do a significant amount of what she did before the accident.

Disembarkation in the presence of snow and ice in winter in Ontario is ordinary and usual use or operation of a motor vehicle.The fall arose from a source independent of the car; there must be a common sense focus on the nature of the risk covered.

A concussion can occur when the head has been physically traumatized in some sort of way. This can occur in a vehicle accident when a person’s head is slammed into a window or other car part. It can also come from a fall.
